Terms of Service

These Terms of Service govern your access to and use of B2B data products and related services provided by BuyDatabase Online.

1. Introduction

These Terms of Service (the “Terms”) form a legally binding agreement between you (“Client”, “you” or “your”) and BuyDatabase Online (“BuyDatabase Online”, “we”, “us” or “our”) governing your access to and use of our business-to-business (“B2B”) data products, lead files, lists, and related services (collectively, the “Services”).

By purchasing, accessing, or using any of our Services, you agree to be bound by these Terms, our Privacy Policy, and our Refund Policy. If you do not agree, you must not use our Services.

1.1 B2B Use Only

Our Services are intended strictly for B2B marketing, sales, analytics, or similar professional use. You represent and warrant that you are acting on behalf of a business entity and not as an individual consumer.

2. User Obligations

You agree to use the Services in strict compliance with all applicable laws, rules, and regulations including, but not limited to:

  • Data privacy and protection laws applicable in your jurisdiction and the jurisdiction of the data subjects;
  • Anti-spam and communications regulations (including but not limited to CAN-SPAM, TCPA, GDPR/PECR where applicable);
  • Do-not-call (DNC) and opt-out regulations;
  • Industry best practices regarding ethical outreach and consent-based marketing.

You are solely responsible for how you use the data provided by BuyDatabase Online and for configuring your own internal processes, consent capture, and suppression mechanisms to remain compliant.

3. Account Registration & Access

Certain Services may require you to create an account, sign an order form, or provide onboarding details. You agree to:

  • Provide accurate, current, and complete information;
  • Maintain the confidentiality of your login credentials;
  • Promptly update us if there are changes to your business contact or billing information;
  • Ensure that only authorized employees or contractors access the Services using your account.

You are fully responsible for all activities that occur under your account. If you suspect unauthorized access, you must notify us immediately at support@buydatabase.online.

4. Orders, Delivery & Payment Terms

4.1 Orders & Scope

Each purchase (for example, a data file, lead batch, or subscription) will be governed by the commercial terms agreed between you and BuyDatabase Online via invoice, proposal, email confirmation, or online checkout (collectively, the “Order”). The Order will define quantity, vertical(s), filters, pricing model, and delivery format.

4.2 Pricing & Payment

Unless otherwise specified in writing:

  • All prices are quoted exclusive of any applicable taxes, duties, or charges;
  • Full payment is due in advance prior to data delivery or activation of Services;
  • Payments must be made via the methods communicated on the invoice or our website.

Late or failed payments may result in suspension or cancellation of access to Services without liability from BuyDatabase Online.

4.3 Delivery of Data

Data may be delivered in one or more of the following ways, depending on the Order:

  • Secure file download (e.g., CSV/Excel);
  • Direct email delivery of data files;
  • API/CRM delivery (where integrated and agreed).

You are responsible for promptly downloading, backing up, and securely storing any data delivered. We are not obligated to maintain indefinite access or re-deliver files beyond reasonable support windows.

5. License & Permitted Use

Subject to your compliance with these Terms and full payment of applicable fees, BuyDatabase Online grants you a non-exclusive, non-transferable, non-sublicensable license to use the purchased data solely for your internal B2B marketing, sales, or analytics activities.

You must not:

  • Resell, redistribute, sublicense, or otherwise transfer the data to any third party without prior written consent;
  • Use the data for consumer (B2C) marketing where this conflicts with applicable law or our policies;
  • Use the data for discriminatory, harmful, or illegal purposes;
  • Attempt to reverse-engineer or derive underlying sources where this is not expressly permitted.

6. Intellectual Property

All intellectual property rights in and to the Services, including compiled databases, website content, branding, and proprietary processes, are owned by BuyDatabase Online or its licensors. Except for the limited license granted under these Terms, no rights are transferred to you.

You may not use our name, logo, or trade dress in a way that implies partnership, endorsement, or certification without prior written approval.

7. Data Accuracy & Disclaimers

We take reasonable commercial efforts to source, validate, and maintain accurate and current B2B data. However, all data is provided on an “as-is” and “as-available” basis. Records may change, become outdated, or contain errors over time.

To the maximum extent permitted by law, we do not warrant:

  • That every record is accurate, complete, or up to date;
  • That your campaigns will achieve a specific response or conversion rate;
  • That our Services will be uninterrupted, error-free, or immune to third-party disruptions.

8. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall BuyDatabase Online, its directors, employees, or suppliers be liable for any:

  • Indirect, incidental, consequential, special, or punitive damages;
  • Loss of profits, revenue, data, or business opportunities;
  • Costs arising from regulatory fines due to your misuse or non-compliant use of data.

Our total aggregate liability arising out of or related to the Services, whether in contract, tort, or otherwise, shall not exceed the total amount paid by you for the specific Order giving rise to the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless BuyDatabase Online from and against any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Your use of the data or Services in violation of these Terms;
  • Your failure to comply with applicable laws or regulations;
  • Any content or communications you send using the data provided.

10. Term, Suspension & Termination

These Terms remain in effect while you access or use the Services. We may, without liability, suspend or terminate access to the Services immediately if:

  • You materially breach these Terms or any applicable policies;
  • We suspect misuse, fraud, or unlawful activity;
  • We are required to do so by law, regulation, or competent authority.

Upon termination, any outstanding fees become immediately due. Your license to use the data already delivered will continue only to the extent permitted by your Order and these Terms.

11. Governing Law & Dispute Resolution

These Terms and any dispute arising out of or relating to the Services shall be governed by and construed in accordance with the laws applicable in the jurisdiction where BuyDatabase Online is legally registered, without regard to conflict of law principles.

The parties shall first attempt to resolve disputes amicably. If not resolved, disputes shall be submitted to the exclusive jurisdiction of the competent courts in that jurisdiction.

12. Modifications to the Terms

We may update or modify these Terms from time to time to reflect changes in our Services, legal requirements, or industry practices. The updated version will be posted on this page with an updated “Last Updated” date.

Your continued use of the Services after any update constitutes your acceptance of the revised Terms.
